I don't think some people know the seriousness around it, or why people are jumping down their throats. they don't know why people are offended. i really don't think most are deliberate when they 'borrow' someone's recipe - so, with that said, i think we all could be a tad bit more accepting that not everyone here is deeply involved in the cooking community, nor do they most likely know copyright issues etc. sure, it's not a great thing, but if people who do know it's plagarized, know that it is, then all is good with the world - don't revisit their pages. You can tell who is reputable on here, usually by the complexity or originality of their recipe.
sometimes i just can't handle the pettiness. this is not something that is going to go away. we are all here for different reasons. i'm here to post recipes that i've created or adapted to make them my own. it makes me feel proud to come up with something that pertains to me and post it for other people. some people come to catalogue their recipes for family and friends. some people come here and post a great new recipe they found in cooking light or real simple. let's be straight about this. you can identify who you are and what you are bringing to this site through your bio. you can give credit where it's due - or not. the only way some people will know it is wrong is with a friendly note perhaps- but maybe not. maybe they are okay with what they are doing. maybe the true author will be pissed or not. does it REALLY matter? (it could if someone decides to sue you - but they might just ask you to give credit or take it down) is it really affecting you so much that instead of coming here and enjoying yourself you'd rather come in here time and time again and throw stones at people who probably don't know it because they aren't aware of this board yet.
this same debate has been going on for MONTHS in here.

this is about sharing recipes. good recipes can come from any source. i seriously doubt that most peoples' recipes on this site are 100% made by them.
and actually, the law states that ny recipe that is published is not actually copyrighted. once a recipe is published, it becomes public domain. meaning that a restaurant can use a recipe out of bon apetit recipe and it isn't infringement, let's not forget anthologies of recipes from many different sources.
our mothers and our mothers' mothers carefully copied down recipes from better homes and gardens and the joy of cooking cookbook on recipe cards to use at bakesales and on our families, and then later to be traded with friends at bridge parties and passed down to us as cherished heirlooms. is this infringement? i think this site is an updated version of this tradition, of sharing recipes that are tried and true for us, despite the source.

Important for our discussion here is an understanding that the originality requirement is very low indeed. The book itself would be entitled to an arrangement copyright but the component pieces would not be protected. Therefore, you could copy a recipe but not copy and republish the entire book. The book is what would be protected, not the individual component pieces."

I was hoping that, and pretty much suspected that individual recipes could be lifted for personal use and spread around without violating any laws. But then there was that blurb about reproducing recipes at the beginning of my books, being very specifically unspecific in nature about lifting individual recipes or the entre volume. Leads one to believe that even a single recipe lifted is a violation.
I would never attempt to copy an entire volume of recipes. It's intuitavely obvious that it is wrong. I sent them the letter anyway. Maybe those people were revenuers hiding behind the trees. We've got them here too. Going to have to check on my still in a couple of days. ; D
I always try to credit the original author. I have some of my original recipes in here too. Maybe a recipe has slipped by without me giving proper credit. Please don't pound sand up my posterity because of it.

Please note that my my original intent on this vent was to point out the blatent misususe of someone elses work w/i hours of publication. It was an exact copy of the page from the magazine, and it just irritated me because it was personal to the person who made the recipe. The mag included a bio of her, and the work she did to make the recipe right. This was merely directed at the person on this site, who picked someting out of of national mag, found it on online and made it her own, on the same day of distribution. She didn't even have time to cook it. She just wanted to post here. Footnote: What drew me to the recipe in the first place was that it sounded fantasic, and I first saw it in the mag. I still am going to make it.

I just think it's kinda silly to waste precious time worrying about what is surely a harmless activity on the part of those who more than likely only want to share recipes that they have tried and liked, no matter where they came from. But then I don't have a lot of time to waste, so arguments like this frustrate me.

Have a "Report this Recipe" button. If the recipe was copied without credit, and a link is provided to the original recipe by the reporter, the recipe gets deleted.

It's so simple to post recipes without violating copyright. The ingredients themselves are no problem. All you have to do is write the description in your own words. Then I rewrite the directions in my own words, as well - besides, there are almost always things I want to say about how I fixed it, myself, that I add in. And I usually re-title the recipe to something I like better.
Once those things are done - and they're so simple to do - you're not going to violate copyright by posting the recipe.
One last thing... I always credit where the recipe came from, if I know. Always. I use "this recipe adapted from" and so on. If you don't know where it's from (as in the unknown newspaper or magazine clipping), but you've rewritten the recipe description, directions, and title... no violation.

Did I say that correctly? Get the idea? Sometimes it really does not matter!
I was stating that the recipes were old... Why would I want to change the instructions? I usually put the original, and then where I change it. I really don't like using current recipes from sites on the net... unless I change them COMPLETELY, meaning I use the idea of their recipe and change it including the ingredients. We all can go to other sites and copy current... we all can buy current cookbooks. I have a couple patti LaBelle cookbooks.. why waste the space on this site? You can get them else where.
My question was concerning the people on here, not the copyrights, these books are a long time out of print. I am concerned with getting along with people here, my friends. And setting and example for newcomers to this site..

I just read a recipe last night in a national magazine, that I just recieved yesterday. It was in a magazine that had ordinary contributors, just like us. Today, I see "that womans" same exact, word for word recipe, including the same picture from the magazine, posted here, as a new recipe, (from a different person from another state, with nothing similar in their bio's.). To the person who "shared" their so called recipe..., you could have given the woman who created it some sort of credit. Additionally, please your brain. We all are foodies. I noticed a similar situation recently as well. A direct copy of a post including the photo from one of my favorite recipe blogs less than 24 hours after the original blog posting. I am 100% positive the poster here is not the blogger who created the recipe. I went to review the Terms of Service and it is a clear violation. I emailed Kristopher but now discover he is MIA so don't expect much to happen. I have no issue if a poster gives proper credit but it's the blatant plagiarism that I am disheartened by. Would love to see some moderators here to address such issues. If we allow the behavior to persist we are all guilty by association.

Agreed. There's been voluminous discussion on this topic on various threads and nothing is being done about it, and I'm not even sure anything CAN be done to put a halt to this graceless activity. Despite serious concerns about this, I'm at a loss as to a solution for this situation. Perhaps one doesn't exist ... I mean, how can you possibly stop someone from committing plagiarism, especially when we are all here "incognito", under assumed names, and perhaps even some are multiple registrants? I'm only glad I'm not the one who's ultimately responsible for the ensuing mess.

There are a lot of copies here from Better homes, Southern Living and a few others with their photos... and at the bottom of some of their pages... is the 'magic c in the circle'. That is a federal crime, if anyone wanted to use it. And you might be here under a assumed name, but if the feds wanted to find you.... your computer leaves an address everytime you sign on.... it leaves a trail.. If your getting on from a cyber cafe or a public area...you might be OK... but from home... your nailed... Bookem Dano!

Unless the publications want to spend the legal fees to chase after recipe plagerists nothing is going to happen. My guess is that once they make their circulation money they do not particularly care, anyway., to pursue the matter I also think what we all object to is the tackiness of misrepresentation of people claiming recipes as their own which we all are observant enough to know is not remotely true.
As my daughter tells our dog... "liar, liar, pants en fuego." (liar, liar, pants on fire) To the tacky ones - our utter disrespect. To the genuinely creative and those honest enough to attribute where their posts are from we send our respect and admiration.
This is just like any other microcosm of the good, evil, and middling members of society.

When you see a recipe obviously plagiarized, why not make a comment below the recipe? "This exact recipe was posted at XXXX yesterday." Or, " I saw this exactg recipe at XXXX. You should have given them credit." Of course, some people have no shame, but this is a growing problem.

I don't think some people know the seriousness around it, or why people are jumping down their throats. they don't know why people are offended. i really don't think most are deliberate when they 'borrow' someone's recipe - so, with that said, i think we all could be a tad bit more accepting that not everyone here is deeply involved in the cooking community, nor do they most likely know copyright issues etc. sure, it's not a great thing, but if people who do know it's plagarized, know that it is, then all is good with the world - don't revisit their pages. You can tell who is reputable on here, usually by the complexity or originality of their recipe.
sometimes i just can't handle the pettiness. this is not something that is going to go away. we are all here for different reasons. i'm here to post recipes that i've created or adapted to make them my own. it makes me feel proud to come up with something that pertains to me and post it for other people. some people come to catalogue their recipes for family and friends. some people come here and post a great new recipe they found in cooking light or real simple. let's be straight about this. you can identify who you are and what you are bringing to this site through your bio. you can give credit where it's due - or not. the only way some people will know it is wrong is with a friendly note perhaps- but maybe not. maybe they are okay with what they are doing. maybe the true author will be pissed or not. does it REALLY matter? (it could if someone decides to sue you - but they might just ask you to give credit or take it down) is it really affecting you so much that instead of coming here and enjoying yourself you'd rather come in here time and time again and throw stones at people who probably don't know it because they aren't aware of this board yet.
this same debate has been going on for MONTHS in here.

The same time I saw it in the mag, the day the mag was delivered,I saw it and the pic verbatim on this site. I guess the kicker for me was the mag described how she reworked the recipe several times to make it work etc...

don't we all have recipes that aren't created by us? jeez, even some of our mothers' prize cake recipes are out of sunset magazine, southern living, etc etc.
this is about sharing recipes. good recipes can come from any source. i seriously doubt that most peoples' recipes on this site are 100% made by them.
and actually, the law states that ny recipe that is published is not actually copyrighted. once a recipe is published, it becomes public domain. meaning that a restaurant can use a recipe out of bon apetit recipe and it isn't infringement, let's not forget anthologies of recipes from many different sources.
our mothers and our mothers' mothers carefully copied down recipes from better homes and gardens and the joy of cooking cookbook on recipe cards to use at bakesales and on our families, and then later to be traded with friends at bridge parties and passed down to us as cherished heirlooms. is this infringement? i think this site is an updated version of this tradition, of sharing recipes that are tried and true for us, despite the source.

I'm hitting the (cook) books again, looking up a recipe for a new cooking friend. And there it was, right in the beginning of the book, a blurb about having to get permission from the publishers before reprinting any of the recipes in any form. I thought those recipes in the book belonged to me because I purchased them. Apparently the publisher doesn't think so. And giving credit is not enough.
Think I saw some food police skulking around my place, hiding behind trees, watching, waiting. I fired off a letter to the publishers for permission to reproduce as to not run afoul of those recipe regulators.

There is a grace is crediting whom and where we find our recipes. To not them. i.e. my mother's adult ed course for the Roslyn Sour Cream Cake, as aided by our Vivian and Gale Gand's Black and White Brownies which I've shared is really rude. you're not attempting to make any money on the recipe, or planning on including it in a book, so it isn't copyright infringement. this is considered a private usage, as we're sharing the recipes with a community, our friends, not trying for a profit.
anyways, i don't think it shows a lack of concern for others to post recipes we enjoy on a website. were it me, i would be highly flattered to see my recipe posted on the web, were i given credit for it. (i don't condone passing others' recipes off as your own.) i seriously doubt that anyone is going to come knocking on your door with intent to sue you over a recipe posting on a free of charge food social network.

The book itself would be entitled to an arrangement copyright but the component pieces would not be protected. Therefore, you could copy a recipe but not copy and republish the entire book. The book is what would be protected, not the individual component pieces."

I was hoping that, and pretty much suspected that individual recipes could be lifted for personal use and spread around without violating any laws. But then there was that blurb about reproducing recipes at the beginning of my books, being very specifically unspecific in nature about lifting individual recipes or the entre volume. Leads one to believe that even a single recipe lifted is a violation.
I would never attempt to copy an entire volume of recipes. It's intuitavely obvious that it is wrong. I sent them the letter anyway. Maybe those people were revenuers hiding behind the trees. We've got them here too. Going to have to check on my still in a couple of days. ; D
I always try to credit the original author. I have some of my original recipes in here too. Maybe a recipe has slipped by without me giving proper credit. Please don't pound sand up my posterity because of it.

of course i realize everyone knows that duplicating an entire published work is inherently wrong :)

A generic disclaimer can be issued when the author is not known. Gleaned from a mag, lifted from a book, remembered from 1914, author unknown, etc.......

I agree we all post recipes that are not our own by all rights. They are from family and friends, and long ago clippings, which we have reworked, or not, because they are great as is. That is understandable, acceptable, and expected in this endeavor. We can not give credit when it is not known where to give it to. This was not the case.
Please note that my my original intent on this vent was to point out the blatent misususe of someone elses work w/i hours of publication. It was an exact copy of the page from the magazine, and it just irritated me because it was personal to the person who made the recipe. The mag included a bio of her, and the work she did to make the recipe right.
This was merely directed at the person on this site, who picked someting out of of national mag, found it on online and made it her own, on the same day of distribution. She didn't even have time to cook it. She just wanted to post here.
Footnote: What drew me to the recipe in the first place was that it sounded fantasic, and I first saw it in the mag. I still am going to make it.

Sharing recipes does not have to mean sharing your own personal inventions every single time you post...obviously we are here to share ANY recipe that we have tried and liked enough to recommend to others. Giving credit? Well, if you can do, and if you can't, try not to worry about it. It's all about the food, isn't it? And the sharing? Chefjeb, Then quit counting. I did. I found that all the quibbling had my priorities turned around. Instead of coming in here to look for great tasting recipes for my family, I was looking at recipes to see if they had been copied from the latest newsletter in my mail box. Also I was checking the newsletters not for something for my family but for something that might have been copied here on this site. THIS IS GETTING RIDICULOUS!!!!

I like it too. I joined. But I like this site better, the atmosphere is more suitable to my taste as a place to come to every day instead of just now and then. There are so many recipe sites, it would actually be a miracle if there weren't repeats and reprints of recipes. I just think it's kinda silly to waste precious time worrying about what is surely a harmless activity on the part of those who more than likely only want to share recipes that they have tried and liked, no matter where they came from. But then I don't have a lot of time to waste, so arguments like this frustrate me.

if a recipe is published, there is an implied consent that it can be republished, as long as the *ENTIRE* work, as it was orginally printed in a unique compilation, is not, (in its entirety- can i stress this enough) republished. however, individual recipes cannot be housed under a copyright law. ingredient lists are not copyrighted. and most recipe indstructions are considered generic, rendering them copyright-less as well. nothing illegal is going on. please refer to the whole picture in my previous posts.

This is getting to be a temptest in a teacup. Anyone or any entity who feels the need to keep their recipes a secret will not publish the recipes. And if forced to publish the contents by some governmental regulation, can claim proprietary information rights so as to protect their market share. Have you noticed the ingredients list of most products on the store do not have the exact quantities listed? They may have to divulge the generic ingredients name but not in exact mixture. The valuable recipes are coveted and protected. They just don't leak out for public consumption, except for the possibility of sabogage. And then maybe were going to court and all of these disclaimers start doing their job. Then again you can't stop someone from reverse engineering a recipe and publishing it. Look at all the copycat recipes.

I think people that post tons of recipes just to be in the popular categories must need some sort of validation in their lives. Whether they're ignored at home, don't have a lot of friends, suffer from depression--whatever the case may be. What I would say is this...it might not be the best thing to do but don't think for a moment that this is the only site with this problem. Others have found "borrowed" recipes at other sites so we aren't the only one.
This person wants some of US to leave if we're not happy with this site but since this person seems to be the one who appears to be the most outraged with, it then maybe IT should be the one finding a new home for arrogant posts and cob waddling.
Just leave the people alone. It's their site too, as this isn't an exclusive know-it-all chef's club. They haven't killed anyone or stolen national treasures, they've posted good recipes and that's it. At least their recipes are for delicious dishes that most of us would love to make, unlike several some recipes on here.
Just give it a rest, chill and call the possee off.

I put recipes on here from cookbooks... and will do so again. If someone does not like it--------------------- don't look! I'm back from vacation, and of course I had to come here to see what the latest was. I am glad to see that it appears this vent is fading out...it's LONG OVERDUE! As I've told many of you already, I came here to find recipes, share what I had, and talk to people who share my same passion for anything to do with the kitchen. Well for the past few days I have been busy posting recipes from the
McCalls Recipe Card Collections, vintage... 1970's. Now I hope there is not a problem with this. I stated months ago I had these and the books and people requested the recipes on here. I don't think you will find them laying around every where.. and if they are on the net in a diffrent area.. well they prob have the same collection as I do.
Before.. you post a scone... my God by the end of the week everyone is posting the same thing... We need to dig deep into our hordes... Check out Grannys recipes.. bring them out in the light.. What's old to them, is new to lots of us! Or brings back great memories...

Yes, I do have a suggestion, which I have posted before:
Have a "Report this Recipe" button. If the recipe was copied without credit, and a link is provided to the original recipe by the reporter, the recipe gets deleted.

It's so simple to post recipes without violating copyright. The ingredients themselves are no problem. All you have to do is write the description in your own words. Then I rewrite the directions in my own words, as well - besides, there are almost always things I want to say about how I fixed it, myself, that I add in. And I usually re-title the recipe to something I like better.
Once those things are done - and they're so simple to do - you're not going to violate copyright by posting the recipe.
One last thing... I always credit where the recipe came from, if I know. Always. I use "this recipe adapted from" and so on. If you don't know where it's from (as in the unknown newspaper or magazine clipping), but you've rewritten the recipe description, directions, and title... no violation.

I was stating that the recipes were old... Why would I want to change the instructions? I usually put the original, and then where I change it. I really don't like using current recipes from sites on the net... unless I change them COMPLETELY, meaning I use the idea of their recipe and change it including the ingredients. We all can go to other sites and copy current... we all can buy current cookbooks. I have a couple patti LaBelle cookbooks.. why waste the space on this site? You can get them else where.
My question was concerning the people on here, not the copyrights, these books are a long time out of print. I am concerned with getting along with people here, my friends. And setting and example for newcomers to this site..
